Accounting & Tax in Venezuela: What You Need to Know

A Venezuelan legal entity pays progressive ISLR corporate income tax, 15% up to 2,000 tax units, 22% from 2,000 to 3,000, and 34% above 3,000, with banks and insurers taxed at a flat 40%, and the annual return due within 3 months of fiscal year-end alongside estimated payments made during the year. IVA runs at 16% (8% on select foodstuffs, plus an additional 15% surcharge on luxury goods), filed monthly for ordinary taxpayers or biweekly for entities designated Sujeto Pasivo Especial. Invoicing runs through fiscal printers for most businesses with a physical point of sale, or a homologated digital-invoicing channel for e-commerce-only sellers. Accounting books, the Libro Diario, Libro Mayor, and Libro de Inventarios, are kept in Spanish and retained 10 years, and financial reporting requires dual inflation accounting: IAS 29 hyperinflationary restatement alongside a separate fiscal inflation adjustment for ISLR purposes. Cross-border related-party transactions with a foreign parent require transfer pricing documentation (Form PT-99) within 6 months of fiscal year-end.

Key Requirements

Progressive ISLR corporate income tax for legal entities (15% up to 2,000 tax units, 22% from 2,000-3,000, 34% above 3,000; a flat 40% for banks and insurers), with the annual return due within 3 months of fiscal year-end and estimated payments required during the year

16% IVA (8% reduced rate on select foodstuffs, an additional 15% surcharge on luxury goods), filed monthly for ordinary taxpayers or biweekly for Sujetos Pasivos Especiales

Invoicing through fiscal printers (máquinas fiscales) for most businesses with a physical point of sale, or a homologated digital-invoicing channel for e-commerce-only sellers

Libro Diario, Libro Mayor, and Libro de Inventarios kept in Spanish, with the Diario legally sealed by the Mercantile Registry before use and all books retained 10 years from the last entry

Dual inflation accounting: IAS 29 hyperinflationary restatement for financial reporting using the BCV's INPC index, alongside a separate fiscal inflation adjustment that recalculates non-monetary assets and liabilities for ISLR purposes

Transfer pricing documentation (Form PT-99, Declaración Informativa de Operaciones con Partes Vinculadas en el Extranjero) due within 6 months of fiscal year-end for cross-border related-party transactions

Common Challenges

Special taxpayer status changes the entire compliance calendar

SENIAT designates larger entities as Sujeto Pasivo Especial by administrative resolution, and once designated, a company moves to biweekly IVA filing and takes on withholding-agent duties on its own separate annual calendar keyed to its RIF digit.

Penalties are now indexed to the exchange rate, not the tax unit

Severe pecuniary penalties are indexed to the TCMMV, the Central Bank's highest official exchange rate, specifically so currency depreciation can't erode their real value the way it once eroded tax-unit-denominated fines.

Bolivar-denominated books coexist with a largely dollarized economy

Accounting records must be kept in bolivars with IAS 29 and fiscal inflation-adjustment restatement, even though a large share of real commercial activity prices and invoices informally in US dollars. Reconciling the two is a recurring, genuine operational challenge, not a one-time setup task.
